1. Overview

This website and online store are operated under the Monroevale trading name. Throughout these Terms, “Monroevale”, “we”, “us” and “our” refer to the store operator. By visiting the website, creating an account or purchasing from us, you agree to these Terms of Service and the policies incorporated into them. If you do not agree, do not use the website or place an order.

2. Eligibility and lawful use

You must be legally capable of entering a binding contract in your location or use the website with the involvement of a parent or legal guardian. You may use the website only for lawful personal or business purposes and in accordance with these Terms.

3. Accounts and security

Where customer accounts are available, you are responsible for providing accurate information, protecting login credentials and activity under the account. Notify us promptly of suspected unauthorised access. We may suspend an account where reasonably necessary to protect the customer, the store or another party.

4. Product information

We take reasonable care to describe and display products accurately. Images, colours and scale can vary by screen, lighting, manufacturing batch or natural material. Measurements are approximate unless stated otherwise. Packaging or minor details may change without materially changing the product. Contact us before ordering where a dimension, material, compatibility or use requirement is essential.

5. Prices and payment

Prices are shown in the currency displayed by the storefront or checkout. Taxes, duties, delivery charges and other applicable amounts are shown or calculated as described during checkout. We may correct obvious pricing or content errors before accepting or dispatching an order. Payment must be authorised through an available payment method.

6. Orders and acceptance

Submitting an order is an offer to buy. An order confirmation acknowledges receipt but does not necessarily constitute final acceptance. We may refuse or cancel an order for reasons including unavailable stock, suspected fraud, payment failure, an obvious pricing error, an unsupported destination or breach of these Terms. Where payment has been collected for a cancelled order, the relevant amount will be refunded.

7. Order accuracy and changes

You are responsible for checking the products, quantities, address and contact details before submitting an order. Contact shop@monroevale.com immediately if a correction is needed. A change or cancellation cannot be guaranteed after fulfilment begins.

8. Shipping and risk

Processing, tracking and estimated delivery information is set out in the Shipping Information page and Shipping Policy. Delivery dates are estimates unless expressly guaranteed. Risk of loss passes as provided by applicable law and the relevant carrier arrangement. We will assist with a delayed, lost, damaged or incorrectly delivered order in accordance with the published policies and mandatory consumer rights.

9. Returns and refunds

Returns, exclusions and refund processing are governed by the Refund and Returns Policy. Nothing in these Terms removes rights that cannot be excluded under applicable consumer law.

10. Prohibited conduct

You must not misuse the website; interfere with security or operation; introduce malicious code; scrape or harvest information unlawfully; impersonate another person; use false payment or identity details; infringe intellectual property or privacy rights; attempt unauthorised access; or use the service for unlawful, fraudulent or abusive activity.

11. Intellectual property

The website design, Monroevale branding, original text, graphics and other store content are owned by or licensed to the store operator and are protected by applicable intellectual-property laws. Product names and third-party marks remain the property of their respective owners. You may not reproduce, distribute, sell or exploit store content without permission except as allowed by law.

12. Reviews, submissions and communications

If you submit a review, message, image or other content, you confirm that you have the right to provide it and that it is accurate, lawful and non-infringing. You grant us a non-exclusive licence to use the content for operating, supporting and promoting the store, subject to the Privacy Policy. We may remove content that is unlawful, abusive, misleading or irrelevant.

13. Third-party services and links

The store is hosted and supported by Shopify and may use third-party payment, analytics, fulfilment, review or support services. Third-party websites and services are governed by their own terms and privacy practices. A link does not constitute an endorsement, and we are not responsible for an external website outside the extent required by law.

14. Service availability and changes

We may update products, prices, features, content or availability. We do not guarantee uninterrupted access to every part of the website. Maintenance, security work, network events or third-party outages can temporarily affect access.

15. Disclaimers

To the maximum extent permitted by law, the website and non-product informational content are provided on an “as available” basis. We do not promise that every error will be corrected immediately or that access will be uninterrupted. Product warranties, if any, are limited to those expressly supplied with the product or required by law.

16. Limitation of liability

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or other non-excludable obligations. Subject to that rule, Monroevale is not liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable from the transaction. Any limitation is applied only to the extent permitted by applicable law.

17. Indemnification

To the extent permitted by law, you agree to compensate Monroevale for reasonable loss caused by your unlawful misuse of the website, infringement of another party’s rights or material breach of these Terms. This clause does not apply where prohibited by consumer law.

18. Termination

We may restrict or terminate access where reasonably necessary because of fraud, security risk, unlawful conduct or material breach. Obligations that by their nature survive termination remain effective, including payment obligations and intellectual-property protections.

19. Severability and waiver

If a provision is found invalid or unenforceable, the remaining provisions continue to apply. A failure to enforce a provision immediately does not waive the right to enforce it later.

20. Entire agreement and order of precedence

These Terms, the Privacy Policy, Shipping Policy and Refund and Returns Policy form the agreement governing the store. Product-specific terms stated at checkout or on a product page apply to that product. Mandatory law prevails where it conflicts with these Terms.

21. Governing rules

These Terms are governed by the laws that apply to the store operator and the transaction, while preserving mandatory consumer protections that apply in the customer’s place of residence.

22. Changes to these Terms

We may update these Terms by publishing a revised version and new effective date. Changes apply prospectively except where law requires otherwise.
